The Short Sale Process

To start the short sale process, our office will collect all of the necessary paperwork required to be provided by the borrower. Our short sale lawyers will work with you to make sure that we present the best possible financial package to your lender. We will then send the paperwork directly to your lender to make the process easier for our clients. We handle all of the follow-up communication with your lender, as well. We will diligently work your short sale file to make sure that the process goes as smooth and quickly as possible.

Your short sale package generally includes:

  • At least two years of tax returns
  • Pay stubs
  • Bank Statements
  • Hardship Letter (we give examples of this)
  • Proof of Residency (only required if the borrower lives in the short sale property. We ask for this to try and obtain relocation assistance for our client’s, which can be as much as $12,000!!)
  • Real Estate documents (listing contract, offer to purchase, HUD-1 statement)

Why a Lawyer is Preferable to a Realtor

Many will have you believe that having the assistance of a realtor is adequate enough for a successful short sale. However, it is important to understand that this is process governed by laws and, without careful navigation, could lead to further legal complications for the seller. At Kelbel Law Offices, we not only have experienced short sale attorneys, but licensed real estate brokers as well.

During your short sale, an attorney can:

  • Negotiate the best deal for you with your bank
  • Help you avoid a deficiency judgement (remaining debt after sale)
  • Answer any legal questions you may have
  • Negotiate a waiver of a deficiency judgement
  • Settle a deficiency judgement for a lesser amount (if any exists)
  • Help prevent the lender from moving forward with a foreclosure
  • Foresee and prevent any complications that could occur in the long-term
  • Protect your interests during every step of the process
  • Expedite the process, average time for a file to be approved is 30 days

A realtor cannot match the scope of the service a skilled and experienced Milwaukee short sale attorney (and licensed real estate broker) can provide. At Kelbel Law Offices, LLC, our attorney is not only a lawyer, but a licensed real estate broker. Her dual disciplines have allowed her to successfully execute, on average, four to six short sale transactions per month.
